Normal man sentanced in battery case

BLOOMINGTON — A Normal man was sentenced to two years of probation and 14 days in jail Monday for his involvement in a drunken melee last year.

David Bateman, 22, was one of four men who broke into an apartment and fought with a group of men on Sept. 11, 2005, during a fraternity party.

Bateman was initially charged with home invasion — a crime carrying a penalty of six to 30 years — but later pleaded guilty to the lesser charge of battery in a negotiated plea agreement.

Assistant State’s Attorney Sandra Thompson on Monday argued Bateman was the first person to break into the apartment in the 600 block of Broadway in Normal.

Thompson, who asked for a 2½-year sentence, said the intruders kicked in the door, threw eggs and caused other damage while fighting in the home.

Bateman said the altercation started after the occupants of the home, standing on a balcony, spat on his group of friends during a fraternity party at a nearby apartment.

“I know what I did was wrong,” Bateman said, blaming the incident on his friends during Monday’s sentencing. “I’m not saying I was at the wrong place at the wrong time, but I was definitely with the wrong people.”

Prosecutors on Monday also tried to link Bateman, an Illinois State University student, to another battery that occurred near campus earlier in the night.

Police said another ISU student identified Bateman as the person who punched him in the face during an attempted robbery in the 300 block of School Street.

Bateman told Judge Ronald Dozier that one of his friends punched the victim after his group of friends got kicked out of a different party.

The attempted robbery charge against Bateman was dismissed as part of the plea agreement in the battery case, according to prosecutors.

" This is why these things occur; there is no deterrence to the crime. Probation and fourteen days in jail? People spend more time in jail than that before even receiving formal charges. What's this say to the other punks on campus? Go ahead and do whatever you feel like doing, you'll probably get away with it and if you don't, the sentence will be light. These spoiled little brats are ruining our society. Young people blame everyone but themselves for their misdeeds and problems. If we're going to make any progress in the courts, we have to make an example of punks like this guy. Also, I guess the University didn't expel him either as it still says that he's a student... great. "

This young man isn't in denial and admitted to his mistake and I believe Judge Dozier's sentencing was fair. "

" its not like you broke into a single family home and started attacking people for no reason. i am sure the fraternity provoked it and he just got in a group and made a stupid decision. I think his punishment is suffice. I imagine the people whose house he broke into would not even want him to go to jail for 6 years and ruin his life for making one stupid, relatively harmless mistake. "

" Students think they can get away with anything these days. Just go through campus on a weekend night, it's just a big sloppy drunken brawl. And there are no consequences for any of them, unless they happen to be unlucky enough to get caught. This is what we get when we allow practically anyone (whose mommy and daddy will write the check) into school here. Anyone remember the days when going to college was a PRIVELEGE, and you actually had to WORK to support yourself while going to school? " If you want to know how to deal with drunken idiots who want to start fights at parties, I advocate pepper spray. Just shoot them in the eyes twice and call the cops on them. If people can't drink without having to hit other people, then they deserve it. Speaking of pepper spray, K's merchandise has canisters on sale for like $8 a piece. Anyone who is planning on having a party should have this stuff on hand. "

" where did he admit to it to me he blamed his buddies on the whole thing and he was identified in an earlier incident so the punishment doesnt fit the crime he should have gotten time in prison. Accidents happen but sounds like they were up to no good anyways "
