Woman sues ex-boyfriend, pals over sex tape

BLOOMINGTON — A woman whose former boyfriend was acquitted of criminal sexual assault and eavesdropping has filed a lawsuit seeking damages against him and two friends relating to a sexually explicit videotape.

The woman is seeking more than $50,000 in damages against Jeff Young, Thomas Robert Hawkins and Kenneth McCoy.

The Pantagraph has not disclosed the woman’s identity in either court case because she is the victim of an alleged sex crime.

In court documents, the woman said Young, her former boyfriend, allowed Hawkins to have sex with her at his home in October 2005 as he and McCoy videotaped the events. The allegations against Hawkins and Young include negligent battery, infliction of emotional distress and intentional invasion of privacy.

The woman acknowledges she and Young had consensual sex earlier in the evening “but she was unaware that Hawkins switched places with Young.”

In March, Young and Hawkins were acquitted by a jury on criminal charges relating to the accusations contained in the civil lawsuit. Criminal charges were not filed against McCoy. During the trial, the woman testified she was intoxicated when the events took place and had no memory of what occurred. She went to police after Young showed her the tape about six months later.

The civil action claims the three men caused her extreme anguish, embarrassment and mental suffering.

Bloomington attorney John Prior is representing the woman. An Aug. 30 case management hearing is scheduled.

Charges still pending against Young and Hawkins in unrelated cases include six counts of predatory criminal sexual assault, one count of sexual exploitation of a child and aggravated criminal sexual abuse against Hawkins. Young was arraigned last week on charges of unlawful delivery of a controlled substance.

" The point was absolution of responsible choices because of intoxication, not that someone's actions aren't wrong. You can't say one person is incapable of making a choice becaue of being drunk and another person can. If you do, then one person's defense becomes another's excuse and that can't become the norm.
