Jury selection to begin in county clerk's trial
BLOOMINGTON — Jury selection is scheduled to begin Wednesday in the trial of McLean County Clerk Peggy Ann Milton, who is accused of theft and official misconduct.
Four former county employees are among witnesses who may testify at Milton’s trial. She has pleaded not guilty to two counts of theft and two counts of official misconduct.
Defense attorney Lee Smith contends the accusations should not be considered criminal offenses. He said the charges stem from a dispute between Milton and employees, and was elevated to a criminal matter.
The theft counts relate to Milton’s alleged demand that employee Betty Cowan transport Milton’s son home from school during office hours. The county official also is charged with using postage stamps owned by the county for charitable purposes. Official misconduct charges are based on the theft counts.
If convicted, Milton would face one to three years in prison on the theft counts and two to five years on the official misconduct charges. Probation is a possible sentence on the felony counts, but Milton would not be allowed to continue in office if convicted of a felony.
Special prosecutor David Rands will handle the case for the state. The prosecutor said earlier that a jury should decide if Milton acted appropriately in using a county employee to perform personal services and county stamps to mail letters for a charitable organization.
