Judge won't reduce sentence for Ecstasy smuggler
PONTIAC — A judge has rejected a motion to reduce the 40-year prison sentence for a Michigan man convicted of smuggling more than 1,500 pills of Ecstasy. Dat Tan Ngo, 33, of Royal Oak, Mich., was convicted in June for two counts of controlled substance trafficking and sentenced July 31. Due to the amount of drugs involved, the case was a Class X felony, which carries a sentence range of 30 to 120 years in prison. “I felt that it was my duty to file a motion to reconsider the sentence because we felt that the sentence was excessive,” Ngo’s attorney, public defender Tracy Smith, said. “Frankly I think the minimum is excessive, but we think it should not be more than the minimum of 30 years.” Livingston County Circuit Judge Harold Frobish said in making his ruling Wednesday that there was no reason to change the sentence. “This is a harsh sentence and it is terrible for you, but it is based on your own terrible judgment,” Frobish told Ngo. In October 2006, Illinois State Police pulled over a sport utility vehicle driven by Loan Ngoc Bui, 37, of Kitchener, Ontario, for speeding on Interstate 55. The drugs were discovered in a subsequent police search. Bui was also sentenced to 40 years and had filed a similar sentence reduction request, but that motion was also denied. Frobish said it is possible both Bui and Ngo could be released after 20 years if they earn credit for good behavior in prison. |
