Man gets 16 years for molesting girl
BLOOMINGTON -- A Lexington man was sentenced to 16 years in prison Tuesday for molesting a girl under age 15. Scott D. Tuttle, 30, pleaded guilty in June to charges of molesting the child in exchange for a potential sentence of no more than 20 years in prison. Assistant State’s Attorney Michelle Brooks asked for the maximum 20-year term allowed under the plea bargain. The charge is a Class X felony, carrying a potential sentence of six to 30 years. Brooks acknowledged the results of psychiatric tests that indicate Tuttle has low intellectual functioning abilities. The prosecutor handed Judge Kevin Fitzgerald several letters written by Tuttle to the victim’s father while Tuttle was in jail awaiting trial for the 2005 offense. “To this day he doesn’t understand the impact of what he did. This would have kept occurring if she hadn’t told someone,” said Brooks. Defense lawyer Rob Carter asked the judge to consider several reports on Tuttle’s mental capacity. “I believe he’s an adult in age only,” said Carter, in his request for a minimum sentence. Fitzgerald said he did not consider Tuttle a pedophile but the judge said he was not convinced that Tuttle’s behavior could be controlled with medication. Tuttle will serve two consecutive terms of eight years. He must serve 85 percent of the sentence for the felonies. |
