Attorney for man charged in baby's death still reviewing case

BLOOMINGTON -- The defense attorney for a Bloomington man charged with killing his girlfriend's son said he is still reviewing evidence in the case.

Joe Mendez, 32, faces charges of first-degree murder and aggravated battery to a child in connection with the April death of three-year-old Logan Bratton. Mendez lived with the boy's mother, Donetta Ernst, and the child in an apartment in the 800 block of West Washington Street.

In a court appearance Thursday, defense attorney James Tusek said he is reviewing DVDs submitted by the state.

Mendez remains in jail in lieu of $100,000. His next court date is Sept. 27.

" once in a great while. This case is one of those times as I know Jim Tusek and he is an allright guy. He has a job that few people want and NO lawyer wants any part of. He is an assistan public defender, and he handles felony cases. This means he does not get to pick and choose his clients as a lot of lawyers do. He also does not get the headline grabbing, high paying clients that many lawyers do. Jim does take what he is given and does an above average job of defending those people accused. I know in this case it would be hard to even attempt to mount a defense, I would just take this creep out back and .............. My hat is off to the public defenders who do try, it is a thankless job. "
