Man accused of driving high in fatal wreck gets bench trial

BLOOMINGTON — A Bloomington man accused of driving under the influence and causing a fatal accident in March has opted for a bench trial on the charges.

Octavius Johnson, 25, of the 600 block of West Market Street, told Judge Robert Frietag he wants the court and not a jury to hear the case against him. Frietag set a Nov. 27 bench trial date on the four counts of aggravated DUI.

Johnson was driving east on Empire Street on March 10 when his car collided at Veterans Parkway with a northbound car driven by Ryan Arnold of Normal, police said.

A passenger in Johnson’s car, DeJuan Lockwood, 25, of Bloomington was killed in the accident. Another passenger in the car, Tiana Hubbard, was critically injured and her sister, Ashanti Hubbard, suffered minor injuries.

Information at a coroner’s inquest into Lockwood’s death indicated that Johnson’s blood-alcohol level was 0.029, less than half the legal limit of 0.08 to drive in Illinois. Both Johnson and Arnold tested positive for tetrahydrocannabinol, or THC, the primary substance that produces the effects of marijuana, according to police.

Frietag told Johnson that if convicted of the allegations he faces three to 14 years in prison on the first two counts and one to 12 years on the later two DUI counts. A conviction on the first two counts would require Johnson to serve 85 percent of any prison sentence, Frietag said.

" Wow! People are ridiclous and should stop balming Ryan Arnold. Arnold had the green light so how is it is fault? The other two cars with speeding of some sort to not see they had a red light! I hope that Arnold is innocent and everyone can get over it! It is sad someone had to die, but maybe there friends should have been more responsible when he was driving! Race is not an issue, so everyone needs to stop pulling the race card! "

Maybe somebody needs to remind you people that Johnson and his friends LIED and tried to put the blame of the accident on Arnold, who actually had the green light that night. Besides, what could they possibly charge him with? There's no way to prove he was high at the time of the accident. Having THC in his system only proves that he was high at some point in the previous month. Ergo, there would be no way to prove the case and his charges would be dropped. People are just made because another black person is giving you all a bad name. Well, how about you people quit breaking the law and start acting like responsibly contributing members of society and this kind of stuff wouldn't happen! "

" Unless the judge is a 'friend' of the defendant, a bench trial is a horrible idea. You only have to convince 1 in 6 for a jury, but you only get one shot with the judge. And odds are the judge isn't a 'friend'. "
