Woman awarded judgment in sex tape case

BLOOMINGTON -- A McLean County judge approved a default judgment Monday against two men sued by a woman over a sexually explicit video she claims was made without her consent.

A confidential agreement also has been reached with a third man accused of participating in the October 2004 incident, said Mark Johnson, the woman’s attorney.

A Dec. 20 hearing is scheduled to determine the amount of damages the woman is entitled to receive.

The Pantagraph has not identified the woman’s identity in criminal and civil proceedings connected to the accusations because she is the victim of an alleged sex crime.

Named in the civil lawsuit filed in April are Thomas Robert Hawkins, Jeff Young and Kenneth McCoy. Hawkins and Young were acquitted in March of criminal sexual assault and eavesdropping charges related to the woman’s complaint. Young is the woman’s former boyfriend.

Criminal charges were not filed against McCoy.

Johnson said Hawkins and Young, who are serving prison terms on matters unrelated to the civil case, did not offer a defense in the civil matter, which sought more than $50,000 from each defendant.

Young, 45, was sentenced to a total of 28 years in prison in September for assaulting and videotaping another woman and selling cocaine. Hawkins, 35, is serving a 12-year term for sexually assaulting three minors.

In testimony at the trial for Hawkins and Young, the alleged victim said she found a video in April 2005 made by Young. He admitted to having another tape that she later saw and turned over to police.

The woman contends she was heavily intoxicated and has no memory of the events that occurred at Young’s home. She admitted that she and Young had consensual sex earlier in the evening but she was unaware that Hawkins switched places with Young at some point.

The civil action alleges the three men caused the woman extreme anguish, embarrassment and mental suffering.

Why should this young woman suffer because she chooses to go home with a convicted 'coke' salesman ( her boyfriend) who gets his grins assaulting and videotaping females and his buddy who sexually assaults minors. " Who cares if you think her judgment was poor? The law isn't supposed to only protect perfect people. If I walk down a seedy street and get mugged, yes you could say I made a mistake, but I would still be the victim of a crime. If you're heavily intoxicated, you cannot give consent. That's a tricky situation, because maybe the other two were drunk too, and didn't think she was objecting to them. That doesn't matter, that's all speculation that we don't know and CAN'T know anything about. There's not enough information to say for sure that she was raped. But it is pretty clear that these two men video taped her without her consent, and that's a crime. You all get so giddy in condeming this woman that you're ignoring the crime. Do you think you're too good to be victimized like she was? Do you think that you would never get too drunk to consent to sex acts? I don't care. This is still a crime even if you think you could have avoided it. "

" Just because her name was not released does not mean that she didn't suffer from extreme anguish & embarassment. Odds are the judge had to view part of the tape in order to prove the tape was real. She claims to be highly intoxicated but that doesn't mean there wasn't a date rape or some other drug put in her drink. She found out about the tapes at a later date, so again, odds are that if there was she would no longer have had traces in her system when she found out what happened & reported it. I'm not saying there were drugs in her drink, just that there may have been. "

Being an adult is having a couple of drinks but being irresponsible is getting totally blown away and not knowing what you do. " This victim never claimed to be "heavily intoxicated". The fact of the matter is this victim was more than likely drugged as she probably had been on several occasions. Please, if you're going to continue to report this story, have your facts straight before printing. What you've printed here has only allowed for people to make disparaging remarks (as already shown in the couple of comments that have been made) about the situation and thus leading to the persecution of the victim of this horrible crime. It's nice of you not to print her name, but continuing to print stories about her case, specifically stories that don't tell the entire truth, is just as victimizing as using her name because SHE knows who she is and unfortunately people on these blogs tend to speak at great lengths and usually in a negative manner about things they know NOTHING of.
