Pelo has offered to help convicted killer obtain a new trial

BLOOMINGTON -- A former Bloomington police sergeant accused of rape has offered to assist Jamie Snow, the Bloomington man convicted of killing a service station worker in 1991, with his efforts to obtain a new trial. | Pelo's letter to Snow (PDF) | Snow's post-conviction motion (PDF) | Special section: Court documents, audio analysis, archive of stories

In a four-page handwritten letter mailed from the McLean County jail, where he is being held on rape charges, Jeff Pelo told Snow that he views Snow’s arguments for a new trial as “eye-opening to say the least and shocking to say the most.”

Snow is serving life in prison for the 1991 slaying of William Little during the robbery of a Bloomington gas station. A jury acquitted Snow’s co-defendant, Susan Claycomb, in 2000 of murder charges related to the case, but Snow was convicted in 2001.

Pelo was dispatched on March 31, 1991, to the scene of the robbery of the Clark Service Station at Linden and Empire streets.

Bloomington police detectives videotaped an interview with Pelo concerning his involvement in the case. Pelo testified at Snow’s trial nearly a decade after the murder but the jury did not see his taped statement.

Pelo, who was arrested in June 2006, now faces his own trial on charges that he sexually assaulted four women between 2002 and 2005 and stalked a fifth woman between 2005 and 2006. A jury is expected to hear opening statements next week.

Last year, Snow sent Pelo information concerning the post-conviction motion he was preparing to file in McLean County Circuit Court.

In the 177-page motion, Snow contends that Danny Martinez, a customer at the service station, was wrong when he testified that he got a clear view of Snow as the suspect was backing out of the station shortly after the robbery.

Pelo testified that he saw Martinez putting air in his tire in the parking lot and getting in his car to leave the station. The former police officer could not recall specific details about Martinez when he took the witness stand.

Snow argues that Pelo’s initial statement to police indicates he was watching Martinez at a time Martinez said he was face to face with the murder suspect.

“The taped interview of Pelo directly contradicted the trial testimony of the state’s main eyewitness, Danny Martinez,” said Snow.

In his Oct. 1 letter, Pelo agreed with Snow’s argument.

“You are correct that I did not see anyone inside the Clark Station. Nor did I see anyone backing out of the station, nor did I see Martinez come face to face with anyone in the parking lot,” Pelo wrote to Snow.

“I have always questioned how he (Martinez) saw someone when I did not,” said Pelo.

Pelo urged Snow to send an investigator to the McLean County jail to speak with him about the case.

Pat Riley and Frank Picl, defense lawyers for Snow’s trial, and appellate counsel Karen Munoz were ineffective in their defense, Snow argued.

A new defense team from The Exoneration Project at the University of Chicago Law School agreed in April to represent Snow in his attempt to secure a new trial.

Project attorney Tara Thompson said Friday that she believes police arrested the wrong suspect.

“It’s obvious to me that he’s innocent,” said Thompson.

The Exoneration Project provides representation for inmates who claim to be innocent of the crimes for which they were convicted.

McLean County Assistant State’s Attorney Bill Workman is handling Snow’s petition for a new trial. Snow’s motion does not contain new information, said Workman.

“Most things have already been addressed. We are in a wait-and-see mode until we see what the new attorneys will look at,” said Workman.

The state appellate court has previously turned down Snow’s appeals.

Snow’s attorneys have until July 28 to file amendments to the motion for a new trial. An Aug. 25 status hearing is set.

" I HOPE JAMIE DOES GET A NEW TRIAL AT LEAST !REMEBER THERE WAS NO DNA, HAIR ,BLOOD, THE ONLY THING THAT TIED HIM TO THE SCENE WAS AN EYEWITNESS THAT DECIDED IT WAS HIM TEN YEARS LATER , NOW PELO SAYS THAT NEVER EVEN HAPPENED IT WOULD BE A CRIME TO HAVE AN INNOCENT MAN IN PRISON FOR ALL THESE YEARS "

" To Concerned1: I know Pelo pretty well and he is not the person you have described. I think your bias is getting the best of you and you have not stated one pertinent fact in either of your postings, just a very near sided opinion. Keep in mind even Jeffery Dahmers family supported him during his trial as most families do in these type cases. However family support does not have anything to do with the actions of the accused. Pelo is grasping at straws here and has had almost two years and three sets of legal minds to plan strategy with. Do you think a trained police officer with that much time and legal talent at his disposal would not come up with some type of TRICKS to pull on the eve of his trial? This is merely a message Pelo is sending to the prosecution that he can throw a wrench in the works of settled cases throughout his career as a cop. I anxiously await your response concerned 1. "

" to Michelle 24-
First of all, when I posted my comment at 11:18, your comment of 10:41 wasn't even there, so there's no reason for you to get upset with me like I'm commenting about your comment. Although I did comment a few minutes later when I saw your comment but alas...it's not been posted yet either but I'm guessing by the time this comment (current time 12:55) posts it will be there and you'll have some other comment to make. I do have respect for those who want to know the truth. Maybe you could have the same respect. As I said in my post, the real story here is about Snow, not about Pelo. Whatever the reasons Pelo is "helping", although he was simply answering Snow's letter doesn't really matter. The fact that he's acknowledging the inconsistencies is enough for me. Everyone deserves a fair trial with all of the evidence presented and that didn't happen for some reason in this case. "

" Re: Birdgirl~ Don't tell me I'm missing the point by asking a valid question. If you can't answer, fine--but have respect for those who want to know the truth, if that could be possible. "

birdgirl wrote on May 17, 2008 11:18 PM:

" I think you're all missing the point here. Snow was convicted of this crime because he had inadequate, ineffective counsel and the prosecutors wanted to lay it to rest and what better way to solve a crime in this town but to convict someone, ANYONE. It's not about the truth...it's about how you play the game and how much money you have to defend yourself! Clearly it's too late now to ever figure out who committed this crime, but at least give Snow a chance to prove his innocence. I'm convinced with a new trial and a good defense, the evidence or lack there of will clear him. "

" To: Paladin: Ummm... I read the letter too and did not reach the same conclusion as you. "Rambling blather?" It seemed to me that the letter was very clear and precise, with simple prayers for Snow. If prayers turn you off that much, then I pray for your soul. "

" Thank you, I hadn't read the letter and now I understand his comments. Please except my apology Floyd.
i am very aware people that commit crimes or are in prison find they are religious, found Jesus and have repented from their wicked ways and I believe that is true in some cases. I also know you will probably see a lot of "religious" convicts just like the best place to find a hypocrite is in church. Thank you for calling my attention to the letter, I rarely click those links, I think I should pay closer attention.
"

Paladin wrote on May 17, 2008 4:00 PM:

" ...to "MRS.": If you read the rambling blather that was Mr. Pelo's letter, you would know why "floyd" talked about "religious crap". Here is my suggestion: read Mark Twain's "Lionizing Murderers" essay. That should readily demonstrate to you how and why incarcerated people suddenly start to write letters espousing profound spiritual conversions or concerns. "

MRS. wrote on May 17, 2008 12:14 PM:

" Floyd, where does it saw anything remotely conected to religion? You will have your chance to get a few digs about religion in a few days. I am sure it will be covered in this paper. As far as evidence against this Jamie Snow I would say there may be something to it but I wouldn't bet money on it. Give him his day in court and what ever happens happens. As far as evidence against Pelo, if he had his face covered there better be a lot of DNA evidence or IMO he will walk. To:concerned1, many families stick behind another family member charged with a crime. Lagroan and Hamm come to mind.
not saying it is wrong, just it really doesn't carry much weight.

The kids (who are all old enough to make their own decisions on this matter) have been there to show support for their father, not as a publicity stunt. The family knows Pelo better than you and their support of him through all of this shows their belief in his innocence. Judge not, lest ye be judged by the same measure! "

Anyone can have two sides to them and I've met quite a few. They do this on TV for all those court shows. Who knows the jury isn't in yet. "
