SA Yoder still considering Beaman retrial

BLOOMINGTON — County prosecutors haven’t decided whether to retry Alan Beaman in the 1993 murder of an Illinois State University student.

Beaman was convicted in 1995 and sentenced to 50 years in prison in the stabbing and strangulation of Jennifer Lockmiller. McLean County State’s Attorney Bill Yoder said Friday he is still exploring options in the case, and hopes to announce a decision before Beaman is returned to McLean County June 26.

The Illinois Supreme Court threw out Beaman’s conviction last month, ruling prosecutors violated his constitutional right to due process of law. The decision cited evidence that implicated a second man, not presented at trial, as well as weak evidence against Beaman.

Beaman remains charged with Lockmiller’s murder.

As of June 26, the case will revert to the way it was initially charged, Yoder said. He would not need an indictment if he wanted to proceed to trial again, he said.

Beaman was convicted before Yoder became state’s attorney.

Yoder said the timing of the court’s decision was particularly difficult because Assistant State’s Attorney Mark Messman, who handled the Beaman post-conviction case for the last six years, has been busy for weeks in the trial against former Bloomington Police sergeant Jeff Pelo.

Yoder said he and appellate prosecutors decided not to petition for another hearing before the state’s high court. Thursday was the deadline for prosecutors to file for the court to review the case.

" dr. evil, because there is a rift in the state's attorney's office. The first assistant is not going to handle a case that is difficult to prove that is high profile. Either they got caught red-handed with evidence or they confessed. And neither Beaman nor Pelo fall into that category. So apparently they go to messman. "

Although, yesterday's article did sound like the County was going to retry because they were talking about Beaman getting bail until the second trial. Mr. Yoder allowed the deadline to seek review of the Illinois Supreme Court's decision [where, one might ask, does one appeal a decision of the Supreme Court?] but the case still pends. " it's interesting how everyone with no knowledge about the court system makes dumb remarks. this case was appealed to the appellate court. they AFFFIRMED his conviction. then there was a post conviction hearing and the prosecutors won that. so only after the case goes through at least two other courts, does it reach the supreme court. the supreme court is not the almighty. just remember the justices who are on the supreme court - they are elected like anybody else. some of them are no smarter than the average joe. "

2) pls. realize that the fact that you/your family and me/my family sleep at night SAFELY is because local law enforcement officers are "out there" protecting neighborhoods/picking up morons who are breaking the law. I'm not completely sure about this, but I THINK lots of jerks committing crimes actually work at night while we're sleeping!!!!
Overall, I think Bloomington, Normal, ISU and McLean County officers do pretty well. I respect your opinion--these are just my thoughts!
PS I'm thinking MANY police officers will make it to heaven in front of lots of other people because they were brave and willing to get some jerk morons "off the streets" at the cost of being hurt or in some cases killed! "

" I guess the fact that they though it out and said they violated his rights tells a little about the honesty of the Mclean count court system!! They lie and twist and hide and what ever they need to do to get a conviction. Its not about putting the right person in jail, its about putting another knotch in ur belt loop. I hope the Blm. police and Mclean County do a lot of praying cause they will have a lot of explaining to do when their time comes to get in those gates of heaven for all the corrept things they do.
