Democratic Sen. Durbin of Illinois says he wants to be fair to Burris and is moving toward accepting him despite the corruption charges facing Burris' patron, Illinois Gov. Rod Blagojevich.
The governor has appointed Burris to the Senate seat that President-elect Barack Obama held.
Burris says his appointment is legal. The former Illinois attorney general plans to return to Washington this week to keep making his case. The Illinois Supreme Court has said it's up to the Senate to decide whether to seat him. Durbin says that will be resolved soon.
Durbin and Burris were on CBS' "Face the Nation" on Sunday.
