BLOOMINGTON - A civil lawsuit filed by the grandmother of an infant who died at a Bloomington daycare center in May accuses the day-care provider of negligence in the child's death.
Brooklyn Andres, two months, was found unresponsive May 16 on a waterbed at PJ's Daycare on South Hinshaw Avenue.
The lawsuit, filed by Kim Logsdon on behalf of the child's estate, states day-care operator Patricia Hoit was negligent when she placed the infant on the waterbed and failed to supervise the child. The day-care center also lacked a sufficient number of certified day-care workers, according to the lawsuit.
The lawsuit, filed by Chicago attorney Barry Doyle, seeks more than $50,000 from Hoit.
In a July coroner's ruling, the death was ruled accidental. The inquest panel stated Hoit did not follow state rules on appropriate sleeping arrangements for children.
The state Department of Children and Family Services suspended the license for the daycare pending an investigation into the child's death. Calls to Hoit for comment were not immediately returned.
A Jan. 9 case management conference is scheduled in the case.
