Unpaid attorney wants out as rapist's counsel

BLOOMINGTON - The attorney for a 17-year-old Bloomington man convicted of raping a woman in her apartment last year wants to withdraw from the case because he hasn't been paid.

Yarii Massey faces 120 years in prison when he is sentenced Aug. 5 for the sexual assault and a string of home burglaries that preceded the attack. Massey, who was 16 at the time of the assault, was convicted in May.

Massey's case was handled in adult court because of the seriousness of the charges.

In a motion filed Monday, defense lawyer Larry Spears asked to withdraw from the case, saying he hasn't been paid and that Massey has not paid for a transcript of the trial. The transcript is needed to prepare for a motion for a new trial Spears planned to argue before the sentencing, according to court documents.

Massey testified during his trial the woman, who is in her 20s, invited Massey into her home after agreeing to give him a ride home. The two did not know each other before the May 2007 incident.

But in her lengthy and emotional testimony, the victim told the jury how Massey sexually assaulted her at knifepoint after he broke into her apartment.

A hearing is set for Friday to determine if Spears will be allowed to leave the case. The Bloomington lawyer also asked that Massey's sentencing be postponed.

The judge could order Spears to stay on the case or appoint a public defender to handle the sentencing.
