Federal judge dismisses bank robber's lawsuit against cops

BLOOMINGTON - A federal judge has dismissed a convicted bank robber's lawsuit against DeWitt County Sheriff Roger Massey and a Champaign County police officer.

William A. Ginglen is serving 40 years in a federal prison in Kentucky on bank robbery and weapons charges. The former engineer and Lewistown village trustee was convicted of a string of Central Illinois bank robberies, including the 2003 and 2004 holdups of the Bank of Kenney in DeWitt County.

Ginglen filed a federal lawsuit in August 2006 against the DeWitt County sheriff and Champaign police officer Mark Vogelzang. Ginglen complained that his foot was injured when Vogelzang used a stunning device during his arrest on Aug. 20, 2004, outside a Champaign apartment building.

Massey participated in the arrest.

The bank robber contends that he was struck with a device known as a "flash-bang," a device designed to create loud noises and bright lights that draw a suspect's attention away from police.

The lawsuit accused Massey and Vogelzang of delaying his medical treatment.

In his order dismissing the lawsuit, U.S. District Court Judge Harold A. Baker wrote that "nothing in Massey's actions or that of the other law enforcement officers suggests that they were deliberately indifferent to Ginglen's wound, deprived him of medical attention, or acted in a way to cause him unnecessary pain or permanent injury."

Still pending in federal court is a lawsuit filed by Ginglen asking that his sentence be reconsidered. He argued that he was unable to understand his plea agreement because he was medicated.
