Fairbury man set for November trial in '05 heroin death

PONTIAC - A Fairbury man faces a November jury trial on charges that include drug-induced homicide.

Chad Whately, 30, waived his rights to a preliminary hearing Wednesday when he appeared in Livingston County Circuit Court.

He is charged with drug-induced homicide, unlawful delivery of a controlled substance, possession of a controlled substance containing heroin and a misdemeanor count of possession of hypodermic needles.

Whatley remains in the Livingston County Jail in lieu of posting a $500,000 bond.

Authorities say Whately delivered heroin to Chad Hammond, 27, of Fairbury on June 7, 2005. Hammond overdosed on the drug and died the next day at a Peoria hospital the next day.

A coroner's jury ruled the death as accidental due to morphine toxicity. Under Illinois law, a person commits drug-induced homicide if he delivers the drug to another person and that person's death is caused by the drug.

The homicide and delivery charges stem from the 2005 incident. The possession charges stem from an incident last week.
