DECATUR - The Macon County Grand Jury on Wednesday indicted Melissa Hilton in connection with the March 7 death of her 11-month-old daughter, Emma. The panel also indicted DeLand-Weldon High School English teacher Randy DeJaynes of Forsyth on four counts of child pornography for allegedly having in his possession, with intent to disseminate, photographs of a boy under age 18 that depicted the boy in an act of masturbation.
Both cases dealt with juveniles, and juvenile detectives for the Decatur Police Department and Macon County Sheriff's Office spent Wednesday morning taking turns testifying before the grand jury.
Hilton was indicted on two counts of involuntary manslaughter and two counts of endangering the life of a child. Macon County State's Attorney Jack Ahola sought indictments for two counts of first-degree murder.
The grand jury declined to indict Hilton for that offense, said Presiding Circuit Judge John K. Greanias, as he read the indictments in open court Wednesday afternoon.
Hilton, 26, is free after posting $4,000 cash bail on her $40,000 bond following her arrest Tuesday.
Greanias ordered Hilton to appear in court today for arraignment on the charges.
Hilton's mother found her unresponsive in the bathtub of her home on Brownlow Drive on March 7. Her infant daughter was floating in the tub. Efforts to revive the child were unsuccessful. A preliminary autopsy was inconclusive as to cause of death.
When police questioned Hilton on March 7, she allegedly told them she had been drinking since the evening of March 6 and consumed about 36 cans of beer, ending about 7 a.m. March 7. She said she could not remember what happened or how she and her daughter got into the bathtub.
The indictments stated Hilton placed Emma in the bathtub with water, entered the tub herself and then passed out, thereby causing the child's death.
Greanias ordered an arrest warrant issued for DeJaynes and set his bond at $25,000.
Macon County Sheriff Jerry Dawson said deputies would serve the warrant as soon as it was issued, though he thought DeJaynes might turn himself in first.
DeJaynes, 56, was arrested Feb. 27 by Piatt County and Macon County sheriff's deputies when a search warrant was executed at his home. One or more computers were seized at that time, and analysis of their hard drives by detectives of the Decatur Police Department's Internet Predator Unit uncovered the alleged pornographic pictures.
DeJaynes was charged March 7 in Piatt County Circuit Court with three counts of aggravated battery for alleged insulting or provoking physical contact with two minors while on school property and with two counts of criminal sexual abuse for two alleged sexual contacts with a high school student.
The school district placed DeJaynes on paid administrative leave when the allegations were leveled against him.
DeJaynes has been free after posting $1,500 cash bail on his $15,000 bond in Piatt County.
