LINCOLN -- A Florida woman accused of providing a false alibi for one of two bothers accused of murdering a Beason family will be allowed to return to Florida, a judge ruled Monday.
Sara Duncan, 43, was charged about three weeks ago with obstructing justice in the investigation into the brutal slayings of Rick and Ruth Gee and three of their children. Duncan is accused of providing a false alibi for Christopher J. Harris, 30, who is charged with murdering the Gee family. His brother, Jason L. Harris, 22, also faces murder charges in the Sept. 21 deaths.
The only survivor of the attack, 3-year-old Tabitha Gee, was hospitalized with serious injuries.
Logan County Judge Thomas Harris agreed with a request from defense attorney Karen Root to allow Duncan to return home to Sarasota, Fla. The Decatur lawyer said she would attend hearings for her client, and Duncan would travel back to Illinois for required court appearances.
A Feb. 22 trial date was set for Duncan, who posted $5,000 to be released from jail last week.
The only time Duncan spoke during the brief hearing was in response to questions from the judge about her willingness to return for hearings. She waived extradition to Illinois.
Logan County Assistant State's Attorney Jonathan Wright did not object to the defense request.
Still in jail in lieu of posting $5,000 is Duncan's daughter, 24-year-old Jennifer Earnest, who also faces obstruction charges related to Chris Harris. Earnest is the girlfriend of Jason Harris, and Chris Harris was once married to Nicole Gee, the daughter of Rick Gee.
Authorities have said they have a motive for the murders but have not released the information.
The Harris brothers are due back in court Wednesday for preliminary hearings when the state must present information, or probable cause, for detaining the brothers, who are being held without bond.
The information about the case could remain under wraps if a grand jury returns indictments, a process that replaces the need for the preliminary hearings. The grand jury hears testimony about a case behind closed doors.
