BLOOMINGTON — YWCA McLean County is asking  that a judge review a decision by the Bloomington Human Relations Commission ordering the payment of fines in a gender discrimination complaint.

The commission sided with Eric Tapley in his claim that he was fired after an argument with a female intern, who was allowed to continue her internship.

The YWCA was ordered to pay $67,647.66 in damages, fines and attorney fees.

In its petition for review, the YWCA argues that the ruling was contrary to evidence presented at the hearing, including a lack of proof that the YWCA was motivated by Tapley's race or gender in terminating him.

Dawn Wall, attorney for the YWCA, also claims the commission did not provide a copy of its findings and recommendation until Jan. 21. The hearings on the matter were held in September, and a decision was issued in December. 

An Aug. 6 case management hearing is set in McLean County court.
