Gary Porter, 41, said he was in the basement of his building at 721 W. Washington St. on Tuesday morning when one of his employees told him a man was looking for a public restroom.

Porter looked out a small window and saw the man approaching the corner of the building and standing as if he was about to urinate.

Porter ran upstairs to stop the man and told him to get on the ground, then put his foot on the man's forearm to hold him down while waiting for police to arrive, he said.

Pontiac Police Maj. Jim Woolford said the man, who is 17 and has a mental disability, was waiting for an Amtrak train to take him to Bloomington. Woolford said officers explained to the man that he couldn't urinate in public and then let him leave.

Porter's building, known as the old Depot, has a waiting room for train passengers, but no public restrooms.

Porter was upset police did not arrest the man and had an officer come back so Porter could fill out a written statement.

"I'm not going to let someone urinate on my building," he said. "I wanted something done. If I would have waited 30 seconds, he would have broken the law and he would have been arrested."

After investigating the incident further and taking Porter's statement, Woolford said the only arrest would be Porter.

"The only offense that was committed was battery, based on the written statement," Woolford said. "People need to call us and don't need to put their hands on people unless it is self-defense. It's not safe."

Porter said the man was very cooperative and at no point complained about being hurt.

Battery is a Class A misdemeanor. Porter was released from custody after posting bond.
