The issue is not whether the oil companies and gas stations are price fixing. The issue is what can we do about it.
When all the area gas stations raise their prices on the same day to the exact amount, I consider that price-fixing. When the price of gas goes up 10 - 20 - 30 cents a day and come down one or two cents a day, I consider that price fixing.
Here's what we can do about it. A large part of the profit picture of gas stations is the sale of sundry items: beer, pop, water, newspapers, food. Some gas stations actually sell hundreds of different items. Buy these items at the grocery, drug or liquor stores. Buy only gas at the gas stations.
